1. Acceptance of Terms

By accessing and using the Aegis Endurance website and application ("Service"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and Aegis Endurance Ltd ("we", "us", "our"). We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice within the application.

2. Description of Service

Aegis Endurance provides an AI-powered endurance coaching platform that creates personalised training plans, analyses performance data, and adapts recommendations based on your progress and physiological markers.

The Service includes:

• AI-generated periodised training plans for triathlon and endurance sports
• Integration with third-party fitness platforms (e.g., Garmin Connect)
• Performance analysis and adaptive plan modifications
• Recovery monitoring and wellness recommendations
• Optional human coach oversight ("Coach-in-the-Loop" programs)

3. Eligibility

You must be at least 16 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

4. Account Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorised access or security breach

You agree to use the Service only for lawful purposes. You are prohibited from:

• Violating any applicable laws or regulations
• Posting or transmitting harmful, threatening, abusive, defamatory, or objectionable content

• Interfering with or disrupting the Service or its infrastructure
• Using the Service for any commercial purpose without our written consent
• Reverse engineering, decompiling, or attempting to extract source code from the Service
• Creating multiple accounts to circumvent restrictions or abuse the Service

7. Intellectual Property

All content, features, and functionality of the Service—including but not limited to text, graphics, logos, icons, images, audio, software, AI models, training methodologies, and the overall design—are the exclusive property of Aegis Endurance or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable licence to access and use the Service for personal, non-commercial purposes. This licence does not include the right to:

• Modify, copy, or create derivative works from the Service
• Use data mining, robots, or similar data gathering methods
• Download or store any content except for personal use
• Remove any copyright or proprietary notices

8. Your Content and Data

You retain ownership of any data you provide to the Service. By using the Service, you grant us a worldwide, royalty-free licence to use, process, and analyse your data solely for the purpose of providing and improving the Service, as described in our Privacy Policy.

You represent that you have the right to share any data you provide and that such data does not infringe the rights of any third party.

9. Third-Party Integrations

The Service may integrate with third-party platforms such as Garmin Connect. Your use of these integrations is subject to the respective third party's terms and privacy policies. We are not responsible for the availability, accuracy, or content of third-party services.

10. Subscription and Payment

Certain features of the Service require a paid subscription. By subscribing, you agree to pay all applicable fees. Subscription terms, including pricing and billing cycles, will be disclosed before purchase. All fees are non-refundable except as required by law or as explicitly stated.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that:

• The Service will meet your specific requirements
• The Service will be uninterrupted, timely, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors in the Service will be corrected

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEGIS ENDURANCE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

13. Indemnification

You agree to indemnify, defend, and hold harmless Aegis Endurance and its affiliates from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. Provisions that by their nature should survive termination shall survive, including ownership, warranty disclaimers, and limitations of liability.

You may terminate your account at any time by contacting us or using the account deletion feature in Settings. Data deletion is handled in accordance with our Privacy Policy.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Aegis Endurance regarding the Service and supersede all prior agreements and understandings.
